ISLAMABAD: Two senior judges of the Supreme Court in Pakistan, Justice Qazi Faez Isa and Justice Sardar Tariq Masood, have written a letter to the Supreme Judicial Council urging them to convene a meeting and probe allegations of misconduct and financial impropriety against their fellow apex court judge, Justice Sayyed Mazahar Ali Akbar Naqvi.
The letter, a copy of which is available with MM News, emphasizes the duty of the Council to inquire into the capacity and misconduct of a judge under Article 209 of the Constitution of the Islamic Republic of Pakistan.
They said that they were waiting for the Chief Justice to convene a meeting of the Council to consider the complaints and to ascertain whether there is substance in the stated allegations.
The letter further mentions that the council should either exonerate the respondent judge and fully restore his honor or submit their report in terms of the Constitution. The judges emphasize that the confidence of the people in the integrity and independence of the judiciary requires them to proceed without any further delay.
It is interesting to add here that the same judges, i.e. Justice Qazi Faez Isa and Justice Sardar Tariq Masood on September 15, 2022, had alleged that Chief Justice of Pakistan Justice Umer Ata Bandial had undermined the Judicial Commission of Pakistan by refusing to accept its decision on elevation of judges.
Reacting to the speech of the CJP delivered during a full court reference on the eve of new judicial year of the Supreme Court of Pakistan, Justice Isa and Justice Sardar Tariq Masood said that though the CJP had said that constitutional institutions should not be undermined, violated or attacked, he himself had undermined the JCP by refusing to accept its decision.
