Contempt of court laws have been in place for a long time in Pakistan, while the National Assembly recently unanimously passed the Contempt of Parliament Bill, 2023, which aims to protect the honor and dignity of Parliament.
The law of contempt of court in Pakistan was made to maintain the authority and integrity of the judiciary. Contempt of court refers to any act or behavior that obstructs the work of the judiciary or undermines the judicial process, defies the authority of the court or interferes with the fair trial of cases. The law against this is a recognized principle in legal systems around the world.
Contempt of court in Pakistan can be divided into two categories: civil contempt and criminal contempt. Civil contempt arises when a person willfully disobeys a court order, judgment or injunction, thereby obstructing the course of justice. In contrast, the Contempt of Parliament Bill, 2023, which was recently passed by the National Assembly, aims to protect the dignity and authority of Parliament and its members. The Bill was introduced with the intention of preventing actions or statements that undermine the authority and dignity of Parliament or its committees.
According to the provisions of the Contempt of Parliament Bill, severe punishment can be imposed for committing contempt of Parliament or any of its committees. On conviction, a person can be punished with imprisonment for a term which may extend to six months, a fine which may extend to one crore rupees or both. The Bill is designed to ensure the smooth functioning and maintain the integrity of a vital democratic institution like the Contempt of Court Act.
The law of contempt of court is mainly focused on protecting the authority and impartiality of the judiciary. Its objective is to provide security to the judiciary and maintain public confidence in the judiciary. Contempt of court may occur within court proceedings or through publications and statements that may controvert ongoing cases.
In contrast, the Contempt of Parliament Bill 2023 focuses on protecting the dignity and privileges of Parliament and its committees. It targets actions or statements that undermine the powers of Parliament, its members or its committees.
The purpose of the Contempt of Parliament Bill is to discourage actions which would undermine the privilege of the House or its members, thereby achieving the objective of upholding the dignity and authority of the legislature.
However, both the Contempt of Courts Act and the Contempt of Parliament Bill 2023 must strike a delicate balance between protecting the integrity of the institutions concerned and upholding citizens’ right to freedom of expression. Freedom of expression is a fundamental right enshrined in the Constitution of Pakistan. It allows individuals to voice their opinions, criticize public institutions and participate in the democratic process.
The law of contempt of court in Pakistan plays an important role in maintaining judicial independence. It protects judges from unnecessary attacks or interference that may affect their impartiality or decision-making process. Contempt of court laws contribute to the stability and credibility of the judiciary, ensuring its independence and ability to administer justice fairly.
On the other hand, the purpose of the Contempt of Parliament Bill 2023 is to uphold the principle of parliamentary supremacy. It protects the powers and privileges of Parliament and its members, allowing them to carry out their legislative functions without fear of undue interference or disrespect.
