Federal govt approaches IHC, seeks cancelation of Azam Swati’s bail

ISLAMABAD: Federal government has approached Islamabad High Court (IHC) with plea to cancel bail granted to PTI Senator Azam Swati in a case related to his controversial tweet regarding Army Chief General Bajwa.

The petition was filed by technical assistant, FIA cyber crime reporting center Islamabad, quoted the controversial tweet of Azam Swati regarding Army Chief, arguing that the bail granted to him by special judge, prevention of electronic crimes court, was illegal and unlawful.

In its petition, the FIA stated that the special judge central in excess of his powers granted bail to Swati. Apart from the Peca 2016, the judge also granted bail to the accused in other sections.

It may be recalled that on October 21, the Special Court Judge Central Raja Asif Mehmood released written verdict today about approval of bail to 74 year old Azam Swati. The court directed PTI leader Swati to deposit surety bonds worth Rs one million.
 
BACKGROUND: It may be recalled that PTI Senator Azam Swati was taken into custody on October 12 by the Federal Investigation Agency’s (FIA) cybercrime unit for allegedly making ‘controversial tweets’ against state institutions, including the army chief.
 
The charge sheet, presented by the FIA, stated that Swati “used false information” through his official Twitter handle, which is likely to incite any Officer, Soldier, Sailor, or Airman in the Army, Navy or Air Force to mutiny.”
