ISLAMABAD: The newly constituted four judges bench of the Supreme Court was also dissolved on Friday as Justice Jamal Mandokhail recused himself after registering a dissenting note.

Just Friday morning, a supplementary cause list was issued by the SC registrar today, showing the new bench includes four judges i.e. Chief Justice of Pakistan Umar Ata Bandial, Justice Ijazul Ahsan, Justice Munib Akhtar and Justice Jamal Khan Mandokhail.

However, even before the proceedings could start, a dissenting note of Justice Jamal Mandokhail surfaced online, saying that yesterday’s order was passed without his consultation, therefore, he is misfit in this bench.
His note of dissent reads “The order was not dictated in the court, not was I consulted by the Honorable Chief Justice. However, impact of the judgement requires consideration in court.”

It is pertinent to mention here that today’s developments followed by yesterday’s events when Justice Aminuddin Khan recused himself from the bench hearing the case since he was a signatory to an order issued by a Justice Faez Isa-led bench, proposing the postponement of all cases instituted under Article 184(3) of the Constitution.
However, the Supreme Court on Friday issued a circular disregarding its 2-judges order wherein it is held that hearing of all cases under Article 184 (3) be postponed until amendments in Supreme Court Rules 1980 on CJP discretionary powers. The Registrar5 of Supreme Court said that order violates rules laid by 5 member larger bench.

Meanwhile, MM News has learnt that the Chief Justice of Pakistan, Justice Umar Ata Bandial, would form a new bench and is expected to resume the hearing today (Friday).
