IHC dismisses plea seeking PM Khan’s disqualification

ISLAMABAD: The Islamabad High Court on Tuesday dismissed a petition seeking disqualification of Prime Minister Imran Khan from parliament.

The petition filed by a citizen Fidaullah maintained that PM Imran Khan had claimed during the Senate election that 16 members of the National Assembly has sold their votes.

He said that Interior Minister Sheikh Rasheed confirmed the premier’s statement, saying that no action can be taken against these MNAs. He pleaded with the court to declare PM Khan disqualified over his confession.

“In my petition, I have sought disqualification of Imran Khan Niazi,” the petitioner argued, making PM’s statement as the premise for disqualification

During the initial hearing of the plea, IHC Chief Justice Athar Minallah declared it as inadmissible. The judge directed the petitioner to ask an MNA from his constituency to file a petition. CJ Minallah dismissed Fidullah’s petition, declaring it non-maintainable.

In December last year, the IHC disposed of a writ petition seeking PM Imran Khan’s disqualification after the petitioner withdrew the case. A division bench, comprising IHC CJ and Justice Arbab Muhammad Tahir, heard the case, which was filed with reference to Sita White.

In 2018, a case was filed against Imran Khan for not declaring Tyrian White as his daughter in his nomination papers. The petitioner had contested that the prime minister should be disqualified under Article 62(i)(f) of the Constitution for providing incorrect information in his nomination papers,

The petitioner was a candidate of the Pakistan Justice and Democratic Party in the last general election. Baloch had later joined the PTI and filed a petition in February 2019 to withdraw the case.
