A three-judge panel of the Supreme Court is set to hear a petition on February 19, seeking a declaration of nullity for the general elections held on February 8.
The bench, comprised of Chief Justice of Pakistan Qazi Faez Isa, Justice Muhammad Mazhar Ali, and Justice Musarrat Hilali, is scheduled to preside over the case, as per the cause list.
Earlier this week, an individual named Ali Khan lodged a private petition with the apex court, asserting the nullification of the polls due to alleged breaches of democratic norms and electoral integrity. This petition was filed three days post the extensive voting process that aimed to elect a new government.
Provisional results from the Election Commission of Pakistan indicated that independent candidates secured the majority of National Assembly seats. However, political entities such as PTI, certain religio-political factions, and nationalist parties in Balochistan have raised objections, alleging electoral misconduct. Conversely, the government maintains that the elections were conducted fairly and highlights the success of candidates supported by Imran Khan’s party as evidence of electoral transparency.
Caretaker Prime Minister Anwaarul Haq Kakar dismissed concerns raised by Western countries and a U.S. Congressman regarding reports of intimidation and voter suppression.
The petition urges the court to direct new elections within 30 days, conducted under the direct supervision and oversight of the judiciary, to ensure fairness, transparency, and accountability. Additionally, it seeks a stay order to halt the formation of a new government until the case is resolved and calls for an investigation into alleged pre-poll rigging.
The petitioner insists that those accountable for undermining the democratic foundations of the nation should be held legally responsible.
