ISLAMABAD: Chief Justice of Pakistan Umar Ata Bandial has said that the election commission is not authorized to disqualify a public representative under Article 62-(i)-F.
Chief Justice Umar Ata Bandial’s remark came during the hearing of Faisal Vawda’s plea against his lifetime disqualification on Thursday.
A three-member bench headed by Chief Justice Umar Ata Bandial along with Justice Mansoor Ali Shah and Justice Ayisha Malik heard the case.
“The election commission settled the matter after reviewing the facts, which was upheld by the high court.” Justice Bandial instructed the audience,” Justice Bandial remarked “Now we should look if the high court’s ruling is relevant or not under Article 62-(i)-F.”
The CJP questioned whether or not the Supreme Court may issue a new declaration pursuant to Article 187.
During the hearing, the court posed two questions regarding Faisal Vawda’s lifetime disqualification.
The bench continued the case’s hearing until November 2009.
