The Sindh High Court has ordered the relevant authorities to appoint a visually impaired lawyer, who had met all eligibility requirements about ten years ago except for a medical certificate, as a judicial magistrate. The court directed that fitness conditions be relaxed in this case.
The bench recognized that Hussain, a practicing lawyer, depends on his legal profession for his livelihood. It clarified that any questions regarding his seniority would be addressed by the administrative committee.
The court also underscored the importance of providing opportunities and ensuring inclusion for all eligible individuals, regardless of their disabilities.
This case originated from a recruitment advertisement published on December 1, 2014, for judicial magistrate positions. Hussain successfully passed the selection process but was denied a medical fitness certificate due to his visual impairment. He was advised to approach the court for relief concerning the medical requirements.
After receiving no response to an application filed with the court registrar, Hussain sought the court’s intervention to relax the medical criteria.
