ISLAMABAD: The Pakistan Tehreek-e-Insaf (PTI) has provided a safe passage to its deviant MNAs by not participating in voting on the no-confidence motion against Prime Minister Imran Khan, as a result, the reference against these 20 deviant members is likely to become ineffective.
On Saturday before voting on the no-trust motion, PTI on behalf of the party Chairman Imran Khan filed a reference to NA Speaker Asad Qaiser against its 20 deviant members. The reference under article 63A of the constitution was submitted to Speaker Asad Qaiser, but now that reference is likely to be ineffective as the dissident member didn’t take part in the voting.
Former Deputy Attorney General Raja Khalid Khan has said that Article 63A of the constitution cannot be applied to 20 deviant members as they did not vote against the party policy.
According to law experts, the defection clause cannot apply in case of having differences with the party policy, it only applies when a member votes against the party line. “In the case of PTI’s dissident MNAs the clause is not applying as they didn’t vote against party policy,” they added.
They further said that if PTI had participated in the voting process and the dissident member would have denied following the party line by voting against the no-trust motion then the defection clause could be applied to them, but PTI gave them safe passage by not participating in the voting.
