Alec Baldwin is set to stand trial in early July after a judge denied a motion to dismiss an involuntary manslaughter case against him. Judge Mary Marlowe Sommer, ruling in favor of prosecutors, rejected claims that FBI forensic testing had compromised key evidence related to the fatal shooting incident on October 21, 2021.
Here are the key things to know.
What is the charge?
Baldwin, facing a charge of felony involuntary manslaughter, will appear in a New Mexico courtroom for the first time since the incident. If convicted unanimously by a jury, he could face up to 18 months in prison. The shooting occurred during a rehearsal at Bonanza Creek Ranch, where Baldwin, star and co-producer of the film “Rust,” discharged a revolver, killing cinematographer Halyna Hutchins and injuring director Joel Souza. Baldwin maintains he did not pull the trigger but only pulled back the hammer.
Central to the trial will be the chaotic atmosphere on the movie set and details surrounding the Italian-made revolver Baldwin used. The origin of the live rounds responsible for Hutchins’ death remains undetermined officially, though prosecutors previously held “Rust” armorer Hannah Gutierrez-Reed responsible, who was convicted of involuntary manslaughter and sentenced to the same potential prison term as Baldwin.
What jurors must decide?
Jurors will decide Baldwin’s fate based on whether prosecutors prove negligent use of a firearm or demonstrate beyond a reasonable doubt that Baldwin acted with total disregard for others’ safety. The trial, expected to last nine days at the First Judicial District Court of New Mexico, will commence with jury selection followed by opening statements and deliberations.
