The Islamabad High Court has directed the federal government to dissolve the CDA as a result of the practical utility of the CDA having ended.
According to details, the Islamabad High Court remarked that the federal government should initiate and complete the process of dissolving the CDA, and all powers and assets of the CDA should be transferred to the Metropolitan Corporation.
The Islamabad High Court stated that the CDA Ordinance was enacted for the establishment of the federal government and its developmental works, but with new laws and governance, the practical utility of the CDA Ordinance has ended.
The court stated that the purpose of establishing the CDA has been fulfilled, and now the government should dissolve it. Islamabad High Court’s Justice Mohsin Akhtar Kayani issued the written verdict. The court stated that it should be ensured that after the transfer of powers, the Islamabad administration is transparent and accountable.
The federal government was directed to ensure the protection of the rights of Islamabad’s citizens under the law. The Islamabad High Court stated that according to the law, taxes cannot be imposed without the approval of the local government, and the CDA has no legal authority to impose taxes such as the right of way or direct access.
The court stated that if the CDA has collected any amount under the said SRO, it should be returned. The CDA had imposed a right of access tax on its petrol pumps and CNG stations, and a direct access tax on housing societies from the main highway.
