ISLAMABAD: A three-member bench of the Supreme Court on Wednesday disposed of a petition accusing former DG ISI Lt. General (r) Faiz Hameed of abduction and land grabbing without getting into the merits of the case.
The bench, led by Chief Justice Qazi Faez Isa and including Justice Athar Minallah and Justice Aminuddin Khan, took up a petition filed by a man named Mueez Ahmad Khan on Wednesday.
The petitioner’s attorney informed the court that on May 12, 2017, the former spy master kidnapped Khan and five other members of his family. In exchange for their release, he charged the retired general with stealing land.
The petitioner asked the court to mandate that the Ministry of Defense prosecute Hameed.
But the bench dismissed the petition without even debating the case’s merits. The petitioner has access to additional forums where their request can be considered, the bench decided.
Justice Isa noted that two petitions on the same subject were presented to the court during the hearing; Zahida Aslam, a British citizen, had filed the other. The court rejected the petitioner’s attorney’s attempt to argue for a postponement so that the client could be ready for the case.
The court would adjourn so that the attorney could prepare his arguments, Justice Isa said.
But when the hearing got back underway, the main topic was that the court’s Human Rights Cell had filed the case.
Former Chief Justice Saqib Nisar had heard the case in his chamber and had sent summons to the FIA and CTD, Justice Isa said.
Jusitce Minallah stated that the cell had not been created in accordance with any law and had been ruled unlawful by the Islamabad High Court.
After that, the bench dismissed the petition and advised the petitioner to seek recourse in other channels.
