The Supreme Court Practice and Procedure Committee has issued a new procedure. The procedure was approved on May 29 under the chairmanship of the Chief Justice.
According to details, the new regulations have now come into effect under the Practice and Procedure Act, 2023. The committee is chaired by Chief Justice Yahya Afridi, with Justice Mansoor Ali Shah and Justice Aminuddin as members.
According to the official statement, the Chief Justice may convene a meeting of the committee at any time, either physically or virtually. For a meeting to be valid, at least two members must be present.
The committee will constitute benches on a regular basis, preferably monthly or every 15 days.
The statement further adds that once a bench is constituted, it cannot be altered unless the procedure explicitly allows it. Any change in the chairman or membership of the committee will not invalidate the formation of the bench.
If the Chief Justice is out of the country or unavailable, a special committee may be formed. The committee may also make emergency changes to a bench in the event of a judge’s illness, death, absence, or recusal.
It is stated in the announcement that emergency decisions must be recorded in writing along with reasons and must be presented in the committee’s next meeting.
The notification states that the Registrar will maintain a complete record of each meeting, decision, and change. The committee holds the authority to amend these regulations from time to time. These regulations shall prevail over other rules as long as they remain in force.
