LHC sets aside ECP notification, stays by-elections in 43 NA constituencies

LAHORE: The Lahore High Court (LHC) on Wednesday set aside notification of the Election Commission of Pakistan de-seating 43 PTI Members of National Assembly, and issued Stay Order for by-elections on the same seats till further order.

It may be recalled that forty-three PTI MNAs on February 2 had requested the Lahore High Court (LHC) to set aside two of their notifications regarding the acceptance of resignations by the National Assembly speaker and seats being declared vacant by the Election Commission of Pakistan (ECP).

Contending that their resignations and de-notification should be accepted along with other party members, the PTI MNAs had sought the LHC directions to the concerned quarters to declare that petitioners had withdrawn their resignations by conduct, words and in writing in accordance with law prior to any acceptance.

Hearing the petition here on Wednesday, Justice  Shahid Karim suspended Speaker’s order of accepting resignations of 43 PTI Members of National Assembly, and issued stay order on by-elections on the same vacant seats.

The LHC issued notices to all relevant parties including Speaker NA and the Election Commission of Pakistan, and instructed them to submit their responses on the matter at the next hearing.
