Former Chief Justice of Pakistan Jawwad S. Khawaja has filed a constitutional petition against the federal government, challenging the proposed 27th Constitutional Amendment.
In his petition, filed under Article 184(3) of the Constitution, the former chief justice argued that Parliament cannot curtail or abolish the constitutional jurisdiction of the Supreme Court.
The petition maintains that the jurisdiction of the Supreme Court cannot be transferred to any other court or forum, asserting that any attempt to do so through the 27th Amendment would be unconstitutional.
Justice (retd.) Khawaja requested the court to strike down any constitutional amendment that seeks to diminish the Supreme Court’s powers and to reaffirm that the Supreme Court itself has the authority to review the constitutionality of constitutional amendments.
The petition also seeks to nullify provisions related to the transfer of High Court judges, stating that granting Supreme Court-like powers to a proposed Constitutional Court would violate the basic structure of the Constitution.
Earlier, a similar petition was filed in the Lahore High Court, also challenging the 27th Constitutional Amendment.
